They’re 4 cases and they must pick 1 case or 2 cases to pursue in order to win.
Azimio la Umoja One Kenya Alliance either they file a case;
1. Against Independent Electoral and Boundaries Commission (IEBC) for not contacting free and fair Presidential election post.
2. File election petition against their opponent Dr. William Ruto president elect for tampering with election procedures
3. File case against Chebukati for announcing President elect without all commissioners approval of results.
4. Results were altered by unknown person (IEBC) systems was hacked during election process
By election petition tabled Supreme Court of Kenya (SCoK) under Judge Martha Koome will determine if IEBC officials or Election results is manipulated.
Depending on judgement by Supreme Court of Kenya 6 judges rule , the results is either the petitions is strong or weak. If petition is weak and doesn’t have proves. The case will be dropped and if the Presidential petitions is strong the Supreme Court with either Nullify the election and order fresh Presidential election or count votes again.
Also after approving results, according to Kenya Constitution SCoK can issue throne to the rightful winner.
If Azimio team file petition against IEBC for not contacting Free and Fair election, Supreme Court will not announced the winner if they win the case rather they’ll Nullify Presidential election and order for a re-run (fresh Presidential election to be contacted after 60days of nullification.
If Azimio files a case of tampered IEBC KEIMS Kit and win, judges will check for proves. And if the case wins also Kenyans will embark on a by election after 60days.
If they file case against President elect William Ruto, this means election was Free and Fair but the winner isn’t the real winner. In this case Supreme Court judges will count votes and announce the winner and give Certificate to the winner.
